2. This an appeal filed by the appellant/insurance company, challenging the impugned award dated 25.06.2024 (Annexure-A/1) passed by the learned 8th Additional Motor Accident Claims Tribunal, Durg (C.G.) in Motor Accident Claim Case No.177/2020.
3. By the impugned award, against the claim of Rs.15,00,000/-, the learned Claims Tribunal awarded compensation of Rs.78,000/- in favour of the respondent No.1/claimant.

Brief facts of the case are that on the date of accident, i.e., on 08.06.2019 claimant was travelling from Durg to Uttar Pradesh along with his family members in the offending vehicle. The offending vehicle was driven rashly and negligently by respondent No.2/driver of the offending vehicle bearing Registration No. CG-07-AQ-4656. When they reached Satna – Maihar Road, they collided with an iron pipe kept on the road side, due to which the claimant suffered serious injuries on his waist, back, abdomen, left hand and other parts of his body. The report of the said accident was lodged in Police Station Uchehra, District Satna (M.P.).
5. The instant appeal is filed only on the ground of excessive compensation having been awarded in their favour.
6. Learned for the appellant submits that the amount of compensation is on the higher side. He further submits that the claimant is entitled to get compensation from the driver/owner only. He further submits that the learned Claims Tribunal has imposed the pay and recover condition without any material.
7. I have learned counsel for the appellant and perused the record of claim case carefully.

8. On appreciation of evidence, the learned Claims Tribunal has assessed the monthly income of the deceased as Rs.7,000/- per month (Rs.7,000 x 4 = Rs.28,000/-). Thereafter, awarded Rs.30,000/- towards pain and suffering, Rs.10,000/- towards attendant and Rs.10,000/- towards transportation charges and nutritional diet, thus, total awarded Rs.78,000/-. The accident was reported to be on 08.06.2019.
9. Looking to the meagre amount of compensation awarded by the learned Claims Tribunal, this Court of the opinion that the aforesaid amount cannot be said to be excessive. Hence, this Court is not inclined to disturb the finding of the learned Claims Tribunal, as there is no illegality or infirmity found in the impugned award. Hence, the instant appeal is liable to be and is hereby dismissed. Sd/-
