The present application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), seeking anticipatory bail in FIR No. 228/2026, registered at Police Station Hari Nagar, Delhi, for the offence punishable under Section 69 of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’).

Learned counsel for the Applicant submits that the relationship between the parties was purely consensual and the Applicant is around 30 years of age whereas the prosecutrix is around 36 years of age. She is a divorcee and knew the full consequences of her act.

filed on record it is clear that there was no promise of marriage.

Per contra, learned APP for the State submits that the prosecutrix has stated that she also met with the Applicant’s mother, who also promised her that they both would get married and now she is in the family way. He further submits that the prosecutrix entered into a physical relationship with the Applicant on the false pretext of marriage.
6. Prosecutrix along with her counsel has appeared through Video Conferencing (‘VC’) and the counsel for the prosecutrix has also opposed the bail application and submits that previously the Applicant made a promise to marry her but subsequently refused to do so.
7. Keeping in view the facts and circumstances of the case as well as the fact that the prosecutrix is in the family way and the FSL Report is still awaited and also keeping in view the allegations, this Court is not inclined to grant anticipatory bail to the applicant.
8. Accordingly, the present bail application is dismissed. Pending application(s), if any, stands disposed of.
9. Needless to state, nothing stated hereinabove shall be construed as an expression of opinion on the merits of the case, and the observations made herein are confined to the consideration of the present bail application.
