The applicant has preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 695/2025, registered at Police Station – Civil Line Rampur, District – Korba (C.G.) for alleged commission of offence punishable under Section 296, 115(2), 351(2), 119(1), 326(f) and 3(5) of the BNS. 2. As per the prosecution story in brief, is that on 03-11-2025 at about 9.30 2 PM in the night, the complainant namely Nikhil Kumar Banjare went at shop of Rajkumar Mahilange with his friend namely Dilharan Miri in his motorcycle bearing Registration Number CG- 12/BR-3218, at that time the co-accused namely Aditya Prakash Martand and his other companion demanded the money for liquor from the complainant and when the complainant denied to give money, the accused persons RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 have abused filthy language to the complainant and also assaulted him from fist, blow and also from the stone and thereafter the accused persons fired the vehicle of the complainant. Thereafter the complainant had made a written complaint before the S.H.O and on the said allegations the present FIR has been lodged. Hence, this application. 3. The learned counsel for the applicant has argued that the applicant is completely innocent and further submitted that the co-accused has been granted regular bail by this Court vide order dated 15.01.2026 passed in MCRC No.9472/2025. Hence, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submitted that though the co-accused has been granted regular bail by this Court vide order dated 15.01.2026 passed in MCRC No.9472/2025, but the said co-accused was arrested and was released on regular bail, and the present one is anticipatory bail application, moreover, the present applicant is the main accused person who is said to have assaulted the injured with stone, and though the injuries sustained to the injured are simple in nature, but there are 3 more criminal antecedents of the applicant which is neither disclosed nor explained by learned counsel for the applicant, which shows that the applicant happens to be a habitual offender. Therefore, the present anticipatory bail application of the applicant is liable to be rejected. 3 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts & circumstances of the case, allegations levelled against the applicant in the FIR, and from the perusal of the records available, it transpires that though the co-accused has been granted regular bail by this Court vide order dated 15.01.2026 passed in MCRC No.9472/2025, but the said co-accused was arrested and was released on regular bail, and the present one is anticipatory bail application, moreover, the present applicant is the main accused person who is said to have assaulted the injured with stone, and though the injuries sustained to the injured are simple in nature, but there are 3 more criminal antecedents of the applicant which is neither disclosed nor explained by learned counsel for the applicant, which shows that the applicant happens to be a habitual offender, thus, I am not inclined to grant anticipatory bail to the applicant. 7. 7. Accordingly, the Second Anticipatory Bail application of the applicant – Aditya Prakash Martand, filed under Section 482 of the BNSS, 2023 in connection with Crime No. 695/2025, registered at Police Station – Civil Line Rampur, District – Korba (C.G.) for alleged commission of offence punishable under Section 296, 115(2), 351(2), 119(1), 326(f) and 3(5) of the BNS, is rejected.
