Hari Ram & Ors. Vs. Dr. Pawnesh Kumar CMP No.20404 of 2026 in COPC No.453 of 2023
13.08.2026 Present: Mr. Yudhbir Singh Thakur, Advocate, for the petitioners.
Mr. Vijay K. Arora, Senior Advocate with Mr. Gaurav Kumar, Advocate, for the respondent.
CMP No.20404 of 2026
This application has been moved by the petitioners seeking modification of the order dated
15.07.2026. In the aforesaid order, the amount as deposited by the respondent-Corporation in the Registry of the Court, was ordered to be released in favour of the applicants/writ petitioners. The order also acknowledged admission on part of learned counsel for the applicants/ writ petitioners of the tabulation made by the non- applicant/respondent of its liability towards the applicants/writ petitioners as correct.
Learned counsel for the applicants/writ petitioners submits that on 15.07.2026, the matter was conducted by his assisting counsel, who inadvertently made such statement. That the petitioners do not admit the tabulation given by the respondent to be correct. That respondent’s liability towards the applicants/writ petitioners is more than the amount deposited by it in the Court.
The above assertion has been disputed by learned counsel for the non-applicant/respondent. According to the non-applicant/respondent, the amount due and admissible to the applicants/petitioners has already been deposited and stands released in their favour.
Be that as it may. Since the question of determining financial liabilities of the non-applicant/ respondent towards the applicants/writ petitioners was not examined in the order dated 15.07.2026 and keeping in view the assertions of the applicants/writ petitioners that the amount due to them from the respondents is more than the amount deposited, in the interest of justice, this application is allowed by granting liberty to the applicants/writ petitioners to seek appropriate remedy in accordance with law for the redressal of their surviving grievances, viz. financial claims from the respondents on the subject matter. All rights and contentions of the parties are left open. To this an extent, order dated 15.07.2026 shall stand modified.
The application stands disposed of in the above terms.
