Petitioner has filed this writ petition seeking following reliefs: “10 1 That, this Hon'ble Court may kindly be pleased to call for the entire records of present case, from the respondents. 10.2 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, thereby directing the respondent authorities to consider and decide the representation preferred by the petitioner for grant of seniority on the post of Upper Division Teacher from 02.07 2008, in accordance with law. 10.3 That, any other relief/ order which may deem fit and just in the facts and circumstances of the case.” 2. Learned counsel for the petitioner submits that petitioner was initially appointed as Assistant Teacher (Science) on 5th August 1993. According to new set up in every Middle School, one Teacher of English subject, one Teacher of Science Subject and one Upper Division Teacher of Arts subject are sanctioned. However, while promoting the fellow teachers subject wise promotion was made and the petitioner was left out and eventually the petitioner was promoted to the post fo Upper Division Teacher (Science) on 15/02/2010 whereas the other persons have been granted promotion in the year 2008. Seniority of the petitioner is granted w.e.f. 07.10.2008, however, petitioner is entitled to get seniority from 02.07.2008. He would submit that the petitioner has filed several representations and lastly on 11.07.2023 to the respondent authorities, however, same is not being decided. Therefore, a direction be issued to respondent authorities to 3 / 3 consider and take decision on the pending representations of the petitioners within specified time frame. 3. Learned State counsel would submit that he is having no objection to the limited prayer made by learned counsel for the petitioner. 4. At this stage, learned counsel for the petitioner submits that petitioner may be permitted to submit fresh representation before respondent authorities ventilating his grievance as raised in this writ petition and the concerned authority may be directed to decide the representation at the earliest. 5. Considering the submission made by learned counsel for the respective parties, without making observation on the merits of the case, I find it appropriate to dispose of this writ petition, permitting the petitioner to file a fresh representation before respondent No 3/ Joint Director, School Education Department, Bilaspur within a period of four weeks from today ventilating all the grievance as raised in this writ petition and if such representation is filed, the same shall be considered decided by the concerned authority within a further period of two months from the date of receipt of the representation. 6.
