BY ITS PRINCIPAL SECRETARY, REVENUE (STAMPS AND REGISTRATION) DEPARTMENT, SECRETARIAT BUILDINGS, VELAGAPUDI, GUNTUR DISTRICT. 2. THE DISTRICT REGISTRAR, REGISTRATION AND STAMPS DEPARTMENT KADAPA, YSR KADAPA DISTRICT, STATE OF ANDHRA PRADESH. 3. THE JOINT SUBREGISTRAR, RURAL OFFICE, KADAPA, YSR KADAPA DISTRICT, STATE OFANDHRA PRADESH. ...RESPONDENT(S): Counsel for the Petitioner: 1. B S VENKATA RAMESH Counsel for the Respondent(S): 1. GP FOR REGISTRATION AND STAMPS (AP) 2 The Court made the following ORDER: The grievance of the petitioner as seen from the relief sought for in the writ petition and the submissions made by the learned counsel for the petitioner is non-consideration of the petitioner’s representation dated 12.11.2018 and inaction on the part of the 2nd respondent, despite the legal notice dated 11.12.2018, for deletion of the Endorsement dated 24.02.2010 made by the 3rd respondent in respect of the house property situated in Sy.No.542 of Chemmumiahpeta village, Kadapa District. 2) Learned counsel for the petitioner, inter alia, submits that the petitioner is the absolute owner of the house property in an extent of Ac.0-05 cents covered by Sy.No.542 of Chemmumiyapeta village, YSR Kadapa District, which was purchased through a sale deed dated 20.07.1998 and the same was registered as document No.P163/1998. He submits that registration of the subject matter property was not affected on the premise that Sy.No.542 of Chemmumiyapeta village is classified as Waqf property. Be that as it may. He submits that Inspector Auditor, Waqfs, YSR Kadapa District, addressed a communication dated 31.10.2016 to the 2nd respondent by submitting the list of Waqf institutions and its attached properties in the proforma Annexure-III. As seen from the said Annexure, it is clear that the said Sy.No.542 is not figured in the prohibited category list and in those circumstances, the petitioner made a representation dated 12.11.2018 to the 2nd respondent with a request to delete the endorsement dated 24.02.2010 referred to above. He further submits that as there is no action the petitioner got issued the legal 3 notice referred to supra, that the same did not yield any response, therefore the petitioner is constrained to file the present Writ Petition. 3) Learned Assistant Government Pleader on the other hand made submissions contending that the writ petition is misconceived and seeks time to file counter affidavit. However, this Court, in the light of the relief sought for and more particularly as the Writ Petition is of the year 2019 instead of granting time for filing counter affidavit deems it appropriate to dispose of the same with a direction to the 2nd respondent to pass appropriate orders on the petitioner’s representation dated 12.11.2018 as expeditiously as possible, in any event within four (04) weeks from the date of receipt of a copy of this order. In the meanwhile, the petitioner is also at liberty to submit a copy of the said representation along with the relevant documents to the 2nd respondent. 4) With the above observation, the Writ Petition is disposed of. No costs. 5) Consequently, the Miscellaneous Applications pending, if any, shall stand closed.
