Affidavit of service filed by the petitioners is taken on record. The Panchayat is not represented despite service. Heard learned counsels for the parties. Learned counsel for the petitioners submits that the petitioners are the recorded owners of the land in question which is recorded as ‘Doba’. The private respondents are raising construction therein by filling up the water body despite the fact that their application for correction of Record of Rights in their favour has been turned down by the concerned authority. The private respondents deny and dispute the allegations made by the petitioners. In view of the fact that the representation submitted by the petitioner before the Panchayat Pradhan in this 2 regard has not been considered till date, the Pradhan, Thakurani Chak Gram Panchayat, being the 2nd respondent herein, is directed to consider and dispose of the representation submitted by the petitioners within four weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioners and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction allegedly raised by the private respondents is found to be unauthorized and illegal, necessary steps be taken in accordance with law. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
