JUSTICE JITENDRA KUMAR ORAL ORDER 5 17-06-2026 Heard learned counsel for the petitioner and learned APP for the State. 2. The petitioner seeks bail, apprehending his arrest, in connection with Nautan P.S. Case No.443 of 2025, dated- 04.09.2025 registered for the offences punishable under Sections 137(2), 87, 3(5) of the B.N.S., 2023. 3. As per allegation, the sister-in-law (saali), wife and a small kid of the Informant were abducted/kidnapped by one Naresh Prasad and when he went to the house of Naresh Prased to ask about his wife and other family members, the other co- accused assaulted the Informant and make him flee away. 4. Learned counsel for the petitioner submits that the Patna High Court CR. MISC. No.19216 of 2026(5) dt.17-06-2026 2/3 Petitioner is innocent and has falsely been implicated in this case. She further submits that he is not named in the FIR. 5. However, learned APP for the State vehemently opposes the prayer of the Petitioner for bail submitting that as per the case diary, the wife and saali i.e Ranju Devi and Anju Devi respectively have been recovered and they have given their statement before the Judicial Magistrate under Section 183 B.N.S.S and in her statement, Anju Devi has clearly stated that the co-accused Naresh Prasad had called her to take her to a market and served tea and the Petitioner, Umesh was also there along with Naresh Prasad and after the taking tea, she lost her sense. It is further alleged that the Petitioner, Umesh has established physical relationship with her four to five times. It shows that the Petitioner, Umesh Ram has also participated in the abduction/kidnaping of the victim and he has also physically assaulted one of the victims, Anju Devi. 6. It is also stated in paragraph no. 2 of the bail petition that the petitioner has not moved this Court earlier either for anticipatory bail or regular one in the instant case. 7. It has further been stated in paragraph no.3 of the bail petition that the petitioner has no criminal antecedents. 8. Considering the nature of allegation and material Patna High Court CR. MISC. No.19216 of 2026(5) dt.17-06-2026 3/3 against the Petitioner, I am not persuaded to enlarge the Petitioner on bail. 9. The present anticipatory bail petition is rejected, accordingly.
