1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-
“a) Pass an order issuing appropriate writ, order or direction, declaring the action of Respondent No. 1 in freezing the Petitioner's bank account without any prior notice or lawful freezing order or direction being served upon or furnished to the Petitioner, and thereafter merely orally informing the Petitioner, upon her visiting the Respondent Bank, on 29.07.2026 of the alleged basis for such freezing, as illegal, arbitrary and unsustainable in law. b) Pass an order issuing appropriate writ, order or direction, more particularly in the nature of mandamus, directing Respondent No. 1 to forthwith de-freeze the Petitioner's bank account bearing Account No. This is a digitally signed order. 097861900001758 maintained in the name of M/s University Ideal and to restore normal operations therein; c) Pass an order issuing an appropriate writ, order or direction directing Respondent No. 1 to remove the restriction/freeze imposed upon the aforesaid bank account, the same having been imposed on the basis of the vague and unsigned/unauthenticated/unstamped/undated communication purportedly emanating from Respondent No. 2, which does not contain any specific direction for freezing or restricting the operation of the Petitioner's bank account. ...”

The brief facts of the case are that the petitioner maintains an account in the name of “University Ideal”, bearing Current Account No. 097861900001758 which has been freezed on 28.07.2026, without prior notice or lawful order/ direction being served upon the petitioner and thereafter orally informing the petitioner that her account has been freezed on the basics of a purported communication between respondent Nos. 1 and
2. Hence the present petition has been filed. 3. Ms.
Veragi, learned counsel for the respondents, has handed over a counter affidavit, which is taken on record, and she draws my attention to Annexure R1/1 which states that certain information and documents are required by Cyber Crime, Police Station, Agra and in the absence of the same, the account has been freezed. 4. I am of the view that freezing of an account has serious consequences as the bank is merely a custodian of the funds of the petitioner. If there are any suspicious activities it is for the enforcement agencies to take steps. This is a digitally signed order. 5. Additionally, for want of some documents, the account of the petitioner should not be and could not be freezed. Mr. Venkatraman, learned counsel for the petitioner, however, states that in order to put a quietus to the entire matter, he shall produce all the documents within one week to the Branch Manager of respondent No. 1. It is expected that within one week thereafter, the account of the petitioner will be defreezed. 6. With these directions, the petition is disposed of, granting liberty to the petitioner to revive the petition in case the account is not defreezed.
