The brief facts are that the petitioner got admission in LLB on 21.07.2024 and on 04.10.2024 the petitioner met with an unfortunate accident and suffered serious head injuries. As a result she fell short of attendance by about 16%. The petitioner made a representation to the respondent No. 1 for consideration of her case for re-admission. 4. Since the petitioner was not permitted, the present petition has been filed. 5. Mr. Rupal, learned counsel for the respondents, draws my attention to the judgment of Tripurari Kumar Jha v. Faculty of Law, University of Delhi & Anr., 2024 SCC OnLine 4220 and more particularly paragraph No. 23.4 which reads as under:- “23.4 Therefore, as the regime obtains today, the university has the power to direct readmission of students detained for the shortfall in attendance. Whether the power should be exercised by the University in a given case would depend, in our opinion, on the genuineness of the reasons put forth by the Student to explain their absence. If such an approach is adopted, It will preserve the object of maintaining high standards in legal education and, at the same time, grant succour to those students who, for genuine reasons, are unable to meet the stipulated attendance criteria.” 6. In view of the said observations of the Division Bench, it is directed that the Dean, Faculty of Law will consider the writ petition as a representation of the petitioner and decide the same in accordance with rules, regulations and paragraph No. 23.4 of the aforementioned judgment This is a digitally signed order.
