Petitioner was engaged through outsourcing as Lab attendant in a Government school in District Bageshwar. His engagement has been discontinued by the outsourcing agency (UPNL) based on a letter issued by Chief Education Officer, Bageshwar. The said letter is on record as Annexure-4 to the writ petition, wherein it is mentioned that petitioner is indifferent towards his duties and he is not extending any cooperation to the school authorities and also to the Science Teacher. 3. Learned counsel for the petitioner submits that the allegations made in the letter are unfounded; petitioner is the sole bread earner and due to his disengagement, he is on the verge of starvation. 4. Learned State Counsel, however, submits that Chief Education Officer was justified in writing letter, as petitioner was not discharging the duties assigned to him. 5. Mr. Neeraj Garg, learned counsel 2026:UHC:2432 appearing for the UPNL submits that the disengagement is because of the letter issued by Chief Education Officer. 6. Since petitioner was not given any show cause notice before issuing letter to UPNL, therefore, the observations made against him in the letter are liable to be ignored. 7. Having regard to the facts of the case, the writ petition is disposed of by permitting the petitioner to make representation for his re- engagement in some other organisation/ department to the UPNL. If he makes such representation within two weeks, the competent authority in UPNL shall pass appropriate order on such representation, as per law, within four weeks thereafter.
