Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking following reliefs :- “10.1 That, the Hon’ble Court may kindly be pleased to call the entire records relating to the case of the Petitioner. 10.2 Issue an appropriate writ, order or direction to respondent No. 2 to decide the pending case / application filed by petitioner before Collector for release of paddy and vehicle within time bound period. 10.3 That, the Hon’ble Court may kindly be pleased to quash the illegal seizure memo / panchnama issued by the Respondent No. 5 & 6. 10.4 Any other relief which Hon’ble Court deem fit and proper in the facts and circumstances of the case and cost of the petition. 1. Learned counsel appearing for the petitioner submits that the petitioner is a Trader, who runs a business under the name of Garg Trading Company. He further submits that on 06.12.2025, the petitioner purchased paddy from Nagar Untari, District – Garhwa,Jharkhand and transported 120 quintals paddy in Tata Pick-up bearing registration No. CG/29/AF/0480 to Rice Mills Pratappur, District – Surajpur and during transportation at Wadrafnagag, District Balrampur-Ramanujganj, the respondent No. 5 illegally seized aforesaid paddy alongwith vehicle and registered case under Section 23 of C.G. Krishi Upaj Mandi Adhiniyam, 1972. Subsequently, on 12.12.2025, another vehicle Truck bearing registration No. CG/15/DJ/7293 of petitioner along with 240 quintals paddy has also been seized by respondent No. 4 on account of same allegations. It is further contended that the petitioner has filed application (Annexure P-5) dated 02.03.2026 for releasing of paddy and aforesaid vehicles to the Collector, Balrampur-Ramanujganj, but the same has not been decided yet. Hence, he prays that this petition may be disposed of directing respondent No. 2 – Collector, Balrampur – Ramanujganj to decide his application (Annexure P-5) dated 02.03.2026 expeditiously. 3 2. Learned counsel for the State / respondents have no objection to allow the limited prayer made by counsel for the petitioner. 3. Having considered the limited prayer made by counsel for the petitioner, this petition is disposed of directing respondent No. 2- Collector, Balrampur- Ramanujganj to decide application dated 2.3.2026 (Annexure P-5 ) filed by petitioner for releasing of paddy and aforesaid vehicles expeditiously preferably within a period of 30 days from the date of receipt / submission of copy of this order. 4. With the aforesaid observation & direction, the writ petition is disposed of. 5.
