JUSTICE M A CHOWDHARY, JUDGE ORDER (17.07.2026) 1. The petitioner, through the medium of present petition, seeks quashing of charges framed against him in case titled “State of J&K Vs. Mandeer Singh & Anr.” in file No. 28 of 2025, FIR No. 06 of 2023 for commission of offences punishable under Sections 420, 471, 120-B & 201 of the RPC. 2. Learned Senior counsel appearing for the petitioner submits that after framing of charge for commission of offences punishable under sections 420, 471, 120-B & 201 of the RPC, in case titled “State of J&K Vs. Mandeer Singh & Anr.” arising out of FIR No. 28/2025 wherein the petitioner is accused No. 1, learned Principal Sessions Judge, Udhampur has retained the case for trial with the same court, despite the fact that these offences are not exclusively triable by the court of Sessions. Learned Senior counsel for the petitioner further submits that this petition be disposed of with a direction to the trial court to consider the plea in this behalf. Based on submission of the learned Senior counsel appearing for the petitioner, the petition is disposed of with a direction to the trial court to examine the matter and if none of the offences of which any of the accused have been charged is exclusively triable by the court of Sessions, the trial be transferred for Magisterial trial. 5.
