The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records pertaining to to the case of the petitoner from the respondent authorities for kind perusal of this Hon’ble Court. 10.2 It is therefore, most respectfully prayed that this Honble Court may be pleaseed to issue a writ of appropriate nature, direction or order, setting-aside the impugned order dated 12.03.2026 (Annexure P/1) passed by the Respodnent No. 4 in the facts and circumstances of the case and pass such other or futher orders as this Hon’ble Court may deem fit and proper in the interest of justice. 10.3 It is therefore, most respectfully prayed that this Hon’ble Court may be pleased to issue a writ of appropriate nature, direction, or order to the respondents authority for grant of all consequential benefit which adversary effected by impugned order dated 12.03.2026 in the facts and circumstances of the case. 10.3 May kindly grant any other relief which this Hon’ble Court may deem fit and proper in the facts and circumstances of the case, including cost of the petition.” 2. Learned counsel for the Respondent/State raises an objection with regard to maintainability of the writ petition on the ground that the petitioner is having an alternate efficacious remedy of appeal under Section 23 of the Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966n (hereinafter for brevity referred to as the Rules, 1966). 3. Learned counsel for the petitioner submits that this writ petition is filed because there is no ground mentioned in the order of suspension to suspend the petitioner. 4. The submissions made by counsel for petitioner is on the merits of the order and not a jurisdiction of the authority to suspend the petitoner and therefore, in the above facts of the case, If the order of suspension is challenged on merits, petitioner can file an appeal before the Appellate Authority also. 3 5. For the foregoing discussion, I am not inclined to entertain this writ petition in view of the alternate remedy available to the petitioner under Rule 23 of the Rules, 1966. Accordingly, the writ petition is dismissed. Petitioner will be at liberty to avail other remedy available under law. Certified copy as per rules.
