1. The instant civil miscellaneous petition has been filed for restoration of W.P(S) No.403 of 2010 to its original file which was dismissed on 20.03.2024 for non-prosecution.
2. By referring paragraph no.3 of the instant petition, the learned counsel appearing for the petitioner has stated that due to engagement of the conducting counsel in another Court on

20.03.2024, the writ petition being W.P(S) No.403 of 2010 was dismissed for non-prosecution by the learned writ Court. It has been submitted that W.P(S) No.403 of 2010 may be restored to its original file otherwise the petitioner may suffer irreparable loss and injury.
3. The learned State counsel has raised no objection, rather a statement has been made that the instant petition for restoration may be allowed so that W.P(S) No.403 of 2010 may be decided on its own merit.
4. Considering such submission and after being satisfied with the cause shown in the instant petition, the present petition for restoration is allowed and W.P(S) No.403 of 2010 is restored to its original file.
5. Accordingly, C.M.P No.442 of 2026 stands allowed and disposed of as such.
