Ms. Ananya Chakraborty, Adv. …for the respondent The Court: The present petition has been filed by the petitioner under Section 36(2) of the Arbitration and Conciliation Act, 1996, seeking stay of the arbitral award dated 07.08.2023. Learned Counsel for the petitioner states that the said award is under challenge before this Court in AP No. 841 of 2023 which is presently pending. In the meantime, the respondent has initiated execution proceeding by filing Miscellaneous Case No. 13 of 2025 before the learned Commercial Court at Rajarhat. The learned Commercial Court vide ex parte order dated 30.01.2026 directed attachment of the bank accounts of the petitioner to the extent of the awarded amount. Thereafter, vide order dated 2 21.04.2026, the learned Commercial Court clarified that the decretal amount is Rs.34,77,627/- and directed attachment of the said amount. Learned Counsel for the petitioner further states that the petitioner is ready to deposit the awarded amount of Rs.34,77,627/-. In view thereof, this Court is inclined to stay the operation of the impugned award, subject to the petitioner depositing the awarded amount along with up-to-date interest with the Registrar, Original Side of this Court. The same shall be deposited within a period of two weeks by way of cash deposit. Upon such deposit, the Registrar, Original Side is directed to invest the same in an interest bearing fixed deposit with auto renewal facility. It is clarified that in the event the petitioner fails to deposit the said amount within the stipulated period, there shall be no stay of the impugned award dated 07.08.2023 and the learned Executing Court shall be at liberty to proceed with the execution proceedings in accordance with law.
