Petitioner has preferred this writ petition under Article 226 of the Constitution of India seeking following reliefs :- “10.1. That the Hon'ble Court may kindly be pleased to direct the respondent authorities for demarcating the land owned by him situated in Khasra Number 70/2, 71/2, 72, 73/2 area respectively 0.26, 0.31, 0.30, 0.12 hectare, Village Mechka, P.H. No. 22, Tehsil Nagri, District Dhamtari, C.G., in the interest of justice. 10.3. That the Hon'ble Court may kindly be pleased to direct the respondent authorities for deciding the representations / applications preferred by the petitioner with regard to his grievance (demarcation /correction of land records), in the interest of justice. 10.4. That, any other relief, which this Hon'ble Court may deem just and fit in facts and circumstances of the case.” 2. Learned counsel for the petitioner would submit that, private respondents have encroached upon his land bearing Khasra No. 72 area 0.30 hectare situated at village Meechka, PH No. 22, Tahsil Nagri, Distt. Dhamtari by cultivating the same. On being application filed by the petitioner, demarcation of land has been carried out and the concerned Revenue Inspector has submitted report dated 16-6-2020 to the respondent No. 4/Tahsildar, Nagri vide Ex. P-6, despite that, no action has been taken by respondent No. 4. Learned counsel further submits that the petitioner is ready to file an application under Section 250 of the CG Land Revenue Code, 1959 (henceforth referred to as ‘CGLRC’), hence this writ petition may be disposed of directing the respondent No. 4 to decide the same expeditiously. 3 3. In reply, learned counsel for the State submits that, alleged report Annexure P-6 dated 16-6-2020 was prepared 5 years prior. He further submits that, if private respondents have encroached on some portion of land of petitioner, then he may file application under Section 250 of the CGLRC, which shall be decided by the respondent No. 4 expeditiously. 4. Heard learned counsel for the parties and perused the material available on record. 5. Having considered the limited prayer made by learned counsel for the petitioner, this petition is disposed of at this stage, granting liberty to the petitioner to file an application under Section 250 of the CGLRC before the respondent No. 4/Tahsildar, Nagri, Distt. Dhamtari within 30 days from today. In the eventuality of filing of such application, respondent No. 4 is directed to decide the same after registering revenue case and carry out fresh demarcation of subject land in accordance with law. 6.
