The prayer sought in the present Writ Petition is as under: “It is prayed that this Hon’ble Court may be pleased to issue an appropriate Writ, order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondent in digging the drainage channel across the petitioners land an extent of 180 sq. yards and an extent of Ac.3-84 cents in Sy.No.19/2 of Bakarapuram, Pulivendula Town, Kadapa District without initiating the land acquisition proceedings is as illegal, arbitrary, high handed and violation of Article 14, 21 and 300-A constitution of India and consequently direct the respondent not to dig the drainage channel across the petitioners land an extent of 180 sq. yards and an extent of Ac.3-84 cents in Sy.No.19/2 of Bakarapuram, Pulivendula Town, Kadapa District without initiating the land acquisition proceedings under the Land Acquisition Act and pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.” 3. Ld. Counsel for the Respondents has drawn the attention of this Court to the Counter-Affidavit filed by the sole Respondent on 09.07.2013. The relevant portion of the Counter-Affidavit is usefully extracted hereunder: “In reply to paras 3, 4 & 5 of the Writ Affidavit, it is respectfully submit that the Public Health Engineering Department has taken up the underground drainage system scheme in Pulivendula Municipality. As part of it the scheme was taken up in Bakarapuram area also. It is not true that the Municipality has illegally entered in the land of petitioner and dug the drainage channel across the petitioners lands, as the work of underground drainage system scheme has taken up by the Public Health Engineering Department. In view of the above, it is prayed that this Hon’ble Court withdraw the Municipality from the 4 case as the Municipality has not taken up the work of underground drainage system scheme and the said scheme was executed by the Public Health Engineering Department.” 4. The above extract of the Counter-Affidavit makes it clear that the sole Respondent herein namely the Pulivendula Municipality has not taken up the work of underground drainage system scheme and the said scheme was executed by the Public Health Engineering Department. While this Counter- Affidavit has been filed way back on 09.07.2013, no steps have been taken up by the Ld. Counsel for the Writ Petitioner either in filing Re-joinder or taking any steps to implead the Public Health Engineering Department. Since the sole Respondent had clearly stated that the construction of the drainage system is not within their domain, this Court is of the opinion that the grievance of the Writ Petitioner cannot be redressed in the present Writ Petition. 5. Accordingly, the present Writ Petition is disposed of. However liberty is is given to the Writ Petitioner to file a fresh Writ Petition, by impleading Public Health Engineering Department, if so advised. 6. With these observations, this Writ Petition stands disposed of. No order as to costs. 7. Interlocutory Applications, if any, stand closed in terms of this order. _________________________________ GANNAMANENI RAMAKRISHNA PRASAD, J Dt: 20.01.2026 Mnr 5 137 HON'BLE SRI JUSTICE GANNAMANENI RAMAKRISHNA PRASAD WRIT PETITION No.10257 OF 2013 Dt: 20.01.2026 Mnr
