State Of Rajasthan, Through P.p. 2. Babu Lal Assistant Sub Inspector Of Police, Police Station Pilani, Distt. Jhunjhunu ----Respondents For Petitioner(s) : Mr. Ripu Daman Singh Naruka, Mr. Ashir Gauri For Respondent(s) : Mr. Rajendra Singh Shekhawat, PP with Mr. Anirudh Singh HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 15/01/2026 1. The present S.B. Criminal Misc. Petition is filed under Section 482 Cr.P.C. for quashing the FIR No.220/2018 dated 16.07.2018 registered at Police Station Pilani, District Jhunjhunu for offences under Section 19/54 of Rajasthan Excise Act, 1950. 2. It is contended by learned counsel for the accused-petitioner that the accused-petitioner has falsely been implicated in this case. Prima-facie, no offence is made out against the petitioner. The petitioner is blind by birth, therefore, the FIR alleged against the petitioner may be set aside. 3. Learned Public Prosecutor has submitted the factual report. The factual report shows that the petitioner was seen along with the other co-accused fleding away after abandoning the vehicle [2026:RJ-JP:1748] (2 of 2) [CRLMP-4116/2018] bearing No. RJ-05-UA-0886, from which 36 bottles of illicit liquor was recovered. It is contended that prima-facie ample evidence is available against the petitioner regarding commission of offence, therefore, the petition may be dismissed. 4. Heard and perused the material available on record. 5. In the FIR, it is specifically stated that the petitioner was seen by the Police Officials and they also tried to nab the petitioner along with the other co-accused, however, they failed to catch the petitioner. The abandoned vehicle was checked by the Police Official and from that vehicle, 36 bottles of illicit liquor was recovered. Thus, the aforesaid facts prima-facie shows that the petitioner was seen running from the place of occurrence. Therefore, the facts shows involvement of the petitioner in the alleged offence, whether, the petitioner is blind and has not committed the offence is a question of trial. 6. Accordingly, the instant petition is devoid of any merit and is hereby dismissed. (PRAVEER BHATNAGAR),J Keshav/43
