P.S. Case No. 183 of 2025 for the offence registered under Sections 111(4), 308(5), 351(2), 352 and 3(5) of Bhartiya Nyaya Sanhita, 2023 and Section 25(6), 26 and 35 of the Arms Act pending in the Court of learned Judicial Magistrate, 1st Class, Ramgarh, is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that the offence of Arms Act will not be made out as nothing has been seized from the possession of this petitioner and he has no criminal antecedent. Similarly situated co-accused has been granted bail by the co-ordinate Bench of this Court. Learned A.P.P. opposed the bail petition. It is submitted that false and misleading statement is made that this petitioner has no criminal antecedent. As per para 52 of the case diary, this petitioner is also involved in Patratu (Bhurkunda O.P.) P.S. Case No. 182 of 2025 for the offence registered under Sections 308(5), 351(2) and 61(2) of the BNS. Under the aforesaid facts and circumstances and criminal antecedent of the Petitioner, this Court is not inclined to enlarge the petitioner on bail.
