The instant contempt case is for alleged, willful and deliberate non- compliance of the order dated 29.08.2023 passed in W.P.(S) No. 7684 of 2017. 2. This Court had passed an order on 08.05.2026 which is being referred as under: “05/Dated: 08.05.2026 1. Learned counsel for the petitioner has submitted that although, as per the entitlement held in favour of the petitioner holding him entitle to the pay scale of Rs.4500-125-7000, an appropriate order has been passed to that effect but the arrears of difference of salary have not yet been paid. 2. Mr. Manish Kumar, learned counsel appearing for the Opposite Party Nos.2 and 3, has submitted that the concerned opposite parties are calculating the arrears and within two weeks, it will be released. 3. Show cause in terms of the aforesaid order has been filed as also the rejoinder affidavit. 4. Mr. A.K. Mehta, learned counsel for the concerned opp. party has submitted that from the date of the order passed by this Court, subject matter of the present contempt case, after holding the petitioner entitled for the pay scale of Rs.4500-125-7000, the same has been calculated and paid from the date of the judgment/order. 5. It has been submitted by referring to the statement made at paragraph- 10 of the show cause that the opp. party no.2 and the present in-charge Registrar had deliberated upon the matter and have arrived at a conclusion that the Institute is to obey the order passed by this Court. 6. It has also been stated therein that the opp. party no.1, the Institute, will have to place the matter in the next meeting of the Board of Governors (BoG) of NIT Jamshedpur which is the competent authority for decision/resolution. 7. It has also been stated that the post of Chairman, BoG NIT Jamshedpur is lying vacant since long as no person has been nominated by the Visitor (The President of India) to act the Chairman, BoG NIT Jamshedpur. 8. It has further been stated that the matter shall be placed before the Board of Governors, NIT Jamshedpur, the competent authority to consider the direction passed by this Court. For ready reference, paragraphs-10 and 11 are being referred as under: “10. That the opposite parties state that after the matter was taken-up for consideration by this Hon’ble Court on 08.05.2026, the opposite party No.2 and the present in-charge registrar was informed about the developments, the opposite party No.2 and the present in-charge registrar have deliberated upon the matter and have arrived at a conclusion that the Institute is bound to obey the order of this Hon’ble Court. However, the opposite party No.2 Institute will have to place the matter in next meeting of the Board of Governors (BoG) of NIT Jamshedpur which is the competent authority for their decision/resolution. 11. That the opposite parties state that the office of the Chairman, BoG NIT Jamshedpur is lying vacant since long as no person has been nominated by the Visitor (the President of India) to act as the Chairman, BoG NIT Jamshedpur. This Hon’ble Court in Cont. Case (Civil) No. 131 of 2026 in the matter of Smt. Anita Kumari Vs. Dr. Gautam Sutradhar & Ors. has noticed this fact. [2026:JHHC:19170] Page | 3 The opposite party No.2, in the light of the Judgment & Order dated 29.08.2023 passed by this Hon’ble Court in WPS No. 7684 of 2017 as also the order dated 08.05.2026 passed by this Hon’ble Court in the present Cont. Case (Civil) No. 999 of 2023 shall place the matter before the Board of Governors (BoG) NIT Jamshedpur, the competent authority, to consider the directions passed by this Hon’ble Court. The opposite parties would thereafter be submitting their Supplementary Show Cause to this Hon’ble Court.” 9. Learned counsel for the petitioner, therefore, has submitted that the entitlement of the pay scale is to be paid from the actual date of entitlement and not from the date of the judgment and the same is being considered by the concerned opp. party. 10. This Court, after having heard the learned counsel for the parties and after considering the stand taken in paragraphs-10 and 11 of the show cause dated 08.06.2026, is of the view that the matter is to be placed for its consideration in the next meeting of the Board of Governors, NIT Jamshedpur, as such, the instant contempt case is to be disposed of. 11.
