The petitioner has challenged the cancellation of tender vide order dated 30th July, 2025 passed by the respondents herein. 3. Mr. Shivam Utkarsh Sahay, learned counsel for the respondents submits that after the cancellation, fresh tender was invited and the work order dated 1st April, 2026 has been issued to M/s. Krishna Infrastructure. 4. Possibly, on account of this further development, the petitioner has lost interest in pursuing this matter. In any event, this petition cannot proceed without the petitioner challenging this work order dated 1st April, 2026 after impleading ‘M/s. Krishna Infrastructure, 2026:JHHC:19223-DB 2 101, Panchvati Point Complex, Bedi Bunder Road, Jamnagar, Gujarat-361002’. 5. Accordingly, we dismiss this petition for non-prosecution but with liberty to the petitioner to file a fresh petition, if so advised, by inter alia challenging the cancellation of the original tender and the issuance of work order dated 1st April, 2026 in favour of M/s. Krishna Infrastructure. 6. All contentions of all parties are, however, left open since we have not adjudicated upon the same. 7. Pending I.As., if any, do no survive and are disposed of. (M. S.
