1. The applicant seeks regular bail in case FIR no. 141/2025 registered at PS Economic Offences Wing (EOW) for commission of offences under Sections 318(4)/338/336(3)/340(2)/61(2) BNS (corresponding Sections 420/467/468/471/120-B IPC). Fact remains that during the pendency of the present application, the applicant has been granted interim bail by the learned Trial Court on 15.07.2026 and continues to be on such interim bail. 2. Besides the abovesaid FIR registered with PS EOW, the applicant is involved in two other FIRs i.e. FIR no. 50/2025, Cyber PS Dwarka, Delhi. He is already on bail in the above said case. The third FIR is FIR no. 510/2025 registered at PS Kalkaji. He is on bail in the said case related to said FIR of PS Kalkaji also. 3. On 22.07.2026, this Court was informed that the applicant/accused had already settled the matters with respect to the FIRs registered by PS Kalkaji and Cyber PS Dwarka and since there were chances of settlement even with respect to the FIR registered by PS EOW, the matter was referred to Delhi High Court Mediation and Conciliation Centre. 4. The report has now been received from Delhi High Court Mediation and Conciliation Centre which indicates that the matter has been amicably settled. The settlement agreement is dated 25.08.2026 whereby the applicant/accused have given his no objection if the amount, recovered from his premises on 26.08.2025, is duly disbursed to all the complainants, rightful claimants, as full and final satisfaction of their dues. 5. There are, reportedly, 34 complainants in FIR registered by PS EOW. They all are also signatories to the above said settlement. 6. The amount, which is to be disbursed to these 34 complainants, has been mentioned in Annexure A, attached with Settlement Agreement dated
25.08.2026. 7. Though these 34 complainants are victims of FIR registered by PS EOW, the amount, which had been paid by them to the accused at the time of alleged inducement, was recovered by the police in other case i.e. FIR related to Cyber PS Dwarka. 8.
The charge-sheets, in all the three matters, have already been filed. 9. In order to ensure that there is no difficulty in disbursement of the amount in terms of the Mediation settlement, the charge-sheet related to PS EOW and the charge-sheet related to PS Kalkaji are hereby directed to be transferred to the Court of learned Chief Judicial Magistrate, dealing with FIR registered by PS Cyber Dwarka. Said Court is also requested to supervise the disbursal of the amount to complainants as per settlement agreement. 10.
Learned counsel for the petitioner submits that a petition (Crl. MC. 1841/2026) seeking quashing of FIR registered by PS Kalkaji has already been filed, which is pending adjudication before learned Coordinate Bench presided over by Hon’ble Mr. Justice Purushaindra Kumar Kaurav and the next date is 18.09.2026. He submits that in view of the wholesome settlement, both the sides would file petitions seeking quashing of the other two FIRs as well. 11. It is informed that there is already a direction that the amount recovered/seized by Cyber PS Dwarka be put in an FDR and reportedly, a revision has been filed by the Investigating Agency for the limited reason that This is a digitally signed order. it would be difficult for them to comply with direction regarding taking photographs of all such notes. The cash amount, so seized, in any case, has to be put in FDR and the disbursement of the amount to the respective complainants has to be through online banking mode or by Demand Draft. No cash amount shall be disbursed to any complainant. 12. Since huge cash amount had been recovered and seized from the premises of the accused, some proceedings have, reportedly, been drawn by Income Tax Department. However, the amount, so seized belong to 34 complainants. They had been, allegedly, cheated and were falsely assured about confirmed admission of their wards in professional courses under NRI/Management quota. They all, under such false assurance, paid cash amount to accused towards registration fee, college fees, donation etc. The amount paid by them was in cash and recovery is also of cash amount. Be that as it may, irrespective of parallel proceedings drawn by Income Tax Department, the amount be disbursed to the concerned complainants/parents of the aspirants in terms of the settlement agreement dated 25.08.2026. Investigating Agency would, however, be at liberty to give requisite information in this regard to the Income Tax Department.
Needless to emphasis, despite such reimbursement, the Income Tax Department would be at liberty to pursue the matter and to take appropriate action against the person from whose possession such cash had been recovered but shall not seek any return/refund from 34 complainants. 13. The petitioner herein is on interim bail as per order given by the learned Trial Court and in terms of the settlement, the applicant would be at liberty to seek extension of such interim bail by filing appropriate application before the learned Trial Court, and to seek regular bail in terms of such settlement This is a digitally signed order. after due disbursal of the amount to all the concerned complainants. 14. In view of the above, learned counsel for the applicant/petitioners does not press for any further relief either in the bail application or in the writ petition. 15. These are also accordingly, disposed of, in the aforesaid terms and in light of the amicable settlement. 16. A copy of this order be sent to all the three concerned Courts for information and requisite compliance. 17. A copy of this order be given dasti under signatures of Court Master.
