The present petition has been filed by the Petitioner under Articles 226 and 227 of the Constitution of India, inter alia, seeking removal of illegal vendors in the Janpath area and Janpath Lane. Further, the prayer of the Petitioner is for allowing the Petitioner to carry on his business at his site in Janpath, Delhi. 3. The Certificate of Vending (hereinafter, ‘CoV’) of the Petitioner has been placed on record which has a Vending ID No. V2025301045. However, no photograph of the vend of the Petitioner has been placed on record. This is a digitally signed order. According to ld. Counsel for the New Delhi Municipal Council (hereinafter, ‘NDMC’), in Janpath Lane, there are no illegal vendors presently conducting the vending activities. Ld. Counsel further submits that the Petitioner is presently vending at Sansad Marg and photographs of the vend of the Petitioner has been placed on record. 5. Heard. Insofar as the removal of illegal vendors is concerned, the same is within the domain of the NDMC which would take action after conducting a proper survey in accordance with law. It is made clear that if there are any illegal vendors found, they would be removed in accordance with law. 6. Insofar as the Petitioner is concerned, the Petitioner has a CoV under the category of ‘Other’. Accordingly, the Petitioner shall be permitted to participate in the survey and strictly vend in accordance with the terms and conditions of the CoV. 7.
