Learned counsel for the petitioner submits that the petitioner is owner of land bearing Plot No.535 area 1.340 hectare, situated at village Chilma Distt. Balrampur Ramanujganj (CG) and in possession and cultivating the land for the last 50 years. But since 2021, respondent No.3 is trying to disturb his possession by showing fabricated deposit receipt of fine amount with regard to encroachment on the said land, whereas that receipt was issued in a case pertaining to one Jiyauddin. He further submits that application dated 25.9.2025 (Annexure P/1) was made to Collector, Distt. Balrampur Ramanujganj for redressal of his grievance, however the same has not been decided yet. Hence, it is prayed that this petition may be
disposed of directing the Collector, Distt. Balrampur Ramanujganj to decide the application (Annexure-P/1) filed by the petitioner expeditiously.
3. Per contra, learned counsel for the State submits that if respondent No.3 is disturbing the possession of the petitioner in the subject land by showing false and fabricated receipt of payment of fine, then the petitioner may lodge FIR or file complaint before concerned Court. The Collector has nothing to do in the matter of personal dispute between the petitioner and respondent No.3, hence, this petition may be dismissed.
4. I have heard learned counsel for the parties and perused the material available on record.
5. If respondent No.3 is disturbing the possession of the petitioner pertaining to the land owned by him by showing false and fabricated receipt of fine amount, which respondent No.3 obtained in a case involving another person, then the petitioner may lodge FIR against respondent No.3 or make
3 private complaint against him. There is nothing to do with the Collector in the instant dispute between the petitioner and respondent No.3, hence, I am not inclined to entertain instant petition invoking extraordinary jurisdiction of this Court, hence, this petition is dismissed.
