1. Heard Mr. T. K. Jha, learned counsel for the petitioner. Also heard Mr. N. K. Jaiswal, learned Dy. Govt. Advocate, appearing for the Respondent/State.
2. The present petition has been filed by the petitioner with the following prayer:
"It is therefore prayed that this Hon'ble Court may kindly be pleased to allow this petition and quash the F.I.R. 373/2024 including the charge-sheet (Annexure P/1) and taking cognizance by the Chief Judicial Magistrate Balodabazar vide order dated 11.09.2024 under section 498A/34 of IPC pending in the court of JMFC Balodabazar (Annexure P/2) in respect of petitioners, in the interest of justice.”
3. After arguing the matter at length, learned counsel for the petitioner states that the husband is not ready for mediation. Hence, he has not filed the petition, and the petitioner, being the mother-in-law and sister-in-law, has filed the petition for quashing of the FIR and prays for withdrawal of the present petition with liberty to file the same afresh.
