Mr. Jitender Sharma, Additional Advocate General, for the respondent-State. Cr.MP(M) No. 1580 of 2026 The present application has been &led for condonation of 179 days’ delay in &ling the appeal. It has been asserted that the applicant had applied for legal aid counsel on 27.12.2025, which was provided to him on 17.1.2026, however, the intimation letter was received by the learned legal aid counsel in the month of March and due to his incarceration, the applicant could not approach his legal aid counsel. Hence the application. Heard. The averments made in the application show that the applicant had applied for legal aid which was duly provided to him and the delay occurred because of the disconnection between the learned legal aid counsel and the applicant, for which the applicant cannot be faulted because he was incarceration. Hence, there is su0cient cause for delay in &ling the appeal; the present application is allowed and the delay in &ling the appeal is ordered to be condoned.
Present application stands disposed of. Cr. Appeal C-SB (ST) No. 5393 of 2026 Since the delay in &ling the appeal has been condoned vide separate order passed in Cr.MP(M) No. 1580 of 2026, the appeal be registered. Notice. Mr. Jitender Sharma, learned Additional Advocate General, appears and waives service of notice on behalf of the respondent-State. Copy of the appeal be supplied to the learned Additional Advocate General. Records be called for.
