Romesh Verma, Judge (Oral): The present petition has been filed alleging non compliance of the judgment as passed by this Court in CWP No. 5281 of 2026 dated 28.04.2026. 2. The learned Additional Advocate General has placed on record office order dated 11.08.2026, which reads as follow:- “Whereas, as per the direction conveyed by the Director of School Education, H.P. Shimla-1 dated 10.08.2026 to implement the judgment delivered by the Hon'ble High Court of HP in letter and spirit, qua the petitioner subject to the final outcome of legal remedy in Inder Singh Thakur Case That the That the CWP No. 4830/2023 titled as Inder Sings Thakur was sent to the Govt and Govt. Vide their letter No. EDN-B1(3)- 3/2025 dated 14.07.2025, has directed that to assail the aforesaid judgment by way of filling LPA before the Hon'ble 1 Whether reporters of Local Papers may be allowed to see the judgment? -2- High Court and the CWP No. 4830/2023, titled as as Inder Singh Thakur has not been attained finality. Hence the benefit was not granted to the petitioner. Now, the Government has given approval to implement the Ex-Petition No. 721/2025 in CWP No 4830/2023-Inder Singh Thakur & Others Vs State of H.P. and others subject to final outcome of LPA filed by the Department. Hence, therefore with the prior approval of the Government vide letter No. EDN-B-E(3)-3/2025 dated 17.12.2025 and in compliance to the direction of Hon'ble Court the petitioners are allowed pay scale of Rs 37600/- after two year of regular service subject to final outcome of LPA and other legal remedies and the undertaking to this effect may be obtained from the petitioners that the overpayment, if any, found in the stages shall be recovered from them accordingly The DDO's concerned are hereby directed to fix the pay of the petitioner immediately and release the arrears as per Finance department instructions from time to time and compliance sent to this office immediately.” 3. Since the judgment passed by this Court stands fully complied with, nothing remains for adjudication in the instant petition and the same is closed.
