Heard Sri Piyush Patel, learned counsel for the applicant and Sri Shatrughan Yadav, learned A.G.A. for the State-respondent. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 207 of 2025, under Section 304(2) of BNS, Police Station- Nautanwa, District- Maharajganj, during pendency of the trial in the court below. 3. Learned counsel for the applicant submits that however, as per allegation, applicant involved along with other accused in snatching the golden chain of the informant but entire allegations levelled against the applicant are totally false. 4. He further submits that during investigation, applicant has been made accused on the basis of the statement of the co-accused Manjeet Kumar, who was arrested at the spot and co-accused Manjeet Kumar has already been released on bail by the coordinate Bench of this Court vide order dated 07.04.2026 passed in Criminal Misc. Bail Application No.6765 of 2026. 5. He further submits, however, apart from the present case, applicant is having criminal history of 13 other cases but his entire criminal history has been explained and it reflects that only due to previous criminal history during investigation, police implicated him in the present matter. He further submits, in majority of the previous cases, applicant is on bail and in the present matter, he is in jail since 25.11.2025 i.e. for last more than five months. 7. Per contra, learned AGA however opposed the prayer but could not dispute the argument on facts advanced by the learned counsel for the applicant. 8. I have heard learned counsel for the parties and perused the record of the case. 9. Considering the argument advanced by learned counsel for the applicant and the facts that the co-accused Manjeet Kumar, who was arrested on the spot, has already been released on bail and criminal history of the applicant has been explained in the instant bail application and in the present matter, applicant is in jail since 25.11.2025, in my view applicant is entitled to be released on bail. 10. Accordingly, without expressing any opinion on the merits of the case, the instant bail application is allowed. 11. Let the applicant- Sanjeet Kumar be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:- (i) The applicant shall appear before the trial court on the dates fixed, unless his personal presence is exempted. (ii) The applicant shall not directly or indirectly, make inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any police officer or tamper with the evidence. (iii) The applicant shall not indulge in any criminal and anti-social activity. 12. In case of breach of any of the above condition, the prosecution will be at liberty to move an application before this Court for BAIL No. 6438 of 2026 2 cancellation of the bail of the applicant. 13. It is clarified that the observations made herein are limited to the facts brought in by the parties pertaining to the disposal of bail application and the said observations shall have no bearing on the merits of the case during trial.
