Writ Miscellaneous Application No. 349/2025 Learned counsel for the applicant has submitted that the lis at hand is already decided by the Hon’ble Apex Court and the Division Bench of this Court. It is submitted that petitioner/applicant was acquitted from the criminal proceedings prior to issuance of notification, therefore, no concealment is ought to be alleged on his part. Learned counsel for the non-applicant has submitted that the matter in hand is rendered infructuous as there was no interim (2 of 2) [WMAP-349/2025] order operative in favor of the applicant and the recruitment process pertains to the year 2003 and as on date approximately 22 years have passed. Heard. For the reasons stated in the memo of application, the same is allowed. Accordingly, order dated 03.03.2025 by which SB CWP No. 280/2004 was dismissed is hereby recalled. Registry is directed to restore back SB CWP No. 280/2004 to its original number. In S.B.
