Applicant seeks regular bail in FIR No.43/2026 registered at PS Bhajanpura for commission of offence under Section 143(4) Bhartiya Nyaya Sanhita, 2023 (corresponding section 370 IPC) & 81 of Juvenile Justice (Care and Protection of Children) Act, 2015. 2. An FIR was registered on 26.01.2026 based on the statement of one Mohd. Adil. He had an argument with his wife Fiza @ Ruhi (co-accused herein). She, feeling annoyed, left matrimonial home with their son, who was hardly 10-20 days old at that time. When complainant went to the house of his brother-in-law (brother of his wife) and brought his wife back, he did not find his son anywhere. His wife told him that believing that he had deserted her, under such exceptional circumstances, she was compelled to sell her newborn baby to meet her expenses and to take appropriate treatment for her other child i.e. elder daughter. 3. Fiza @ Ruhi was arrested on 27.01.2026 and continues to be in incarceration. Her brother Zuber was also arrested who had, allegedly, received a sum of Rs. 95,000/- in lieu of the sale of the aforesaid newborn This is a digitally signed order. Admittedly, the aforesaid baby was, eventually, recovered from the possession of applicant Vinod Kumar as he himself brought such child to the police station on 27.01.2026. He claimed that aforesaid child was given to him by a lady named Indu. Indu has also been arrested. 5. As per allegations appearing on record, Fiza @ Ruhi, had conspired with her family members, including her brother-Zuber, Kavita and Tarannum and in furtherance of such conspiracy, the new born child was sold for a sum of Rs. 2.95 lacs. 6. During investigation, a sum of Rs. 2 lacs in cash was also recovered from the possession of Fiza @ Ruhi. The investigation also reveals that a sum of Rs. 95,000/- was transmitted online by accused Tarannum @ Tanu (applicant herein) to the bank account of accused Zuber and there is no explanation from the side of the applicant about the abovesaid transfer. 7. Learned APP for State submits that applicant herein is a crucial intermediary and is directly responsible for the child trafficking of a new born child. It is also submitted that the Call Detail Record (CDR) also substantiates the fact that at the relevant time, she was present at the spot where the new born child was sold, in pursuance to the abovesaid conspiracy. Moreover, as already noticed above, there is online transfer of Rs. 95,000/- by her to co-accused Zuber (maternal uncle of child) which has not been explained in any manner whatsoever. 8. The case has, though, been committed but the charges are yet to be ascertained and keeping in mind the enormity of the allegations, this Court at this juncture, does not find any compelling reason to release her on bail. 9.
