1. This hearing has been conducted through hybrid mode. 2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as ‘BNSS’], seeking quashing of FIR No. 0293/2022, registered at Police Station Mansarovar Park, District Shahdara, Delhi for offences punishable under Sections 498A and 406 read with Section 34 of the Indian Penal Code, 1860 [hereinafter referred to as ‘IPC’] read with Section 4 of the Dowry Prohibition Act, 1961, and all proceedings emanating therefrom, on the basis of an amicable settlement arrived at between the parties vide Settlement Deed dated

State. 4. The Petitioners and Respondent No. 2 are present before this Court and have been duly identified by the Investigating Officer [IO] and their respective learned counsels. 5. Briefly stated, petitioner No. 1 and respondent No. 2 were married on 30.01.2019 according to Hindu rites and ceremonies and a daughter was born from the wedlock on 31.10.2019. Owing to matrimonial disputes between the parties, respondent No. 2 lodged the aforesaid FIR. The proceedings arising therefrom are pending as Criminal Case No. 14213/2024, titled State v. Bala Devi & Ors. During the pendency of the matrimonial proceedings, the parties amicably resolved their disputes before the Delhi Mediation Centre, Karkardooma Courts, Delhi, vide Settlement Agreement dated 16.08.2024. In terms thereof, petitioner No. 1 and respondent No. 2 resumed cohabitation and agreed to resolve the proceedings pending between them. The present petition has accordingly been filed seeking quashing of the aforesaid FIR and all proceedings emanating therefrom. 6.
On a query made by this Court, respondent No. 2, who has been duly identified by the IO, has stated that she entered into the Settlement Agreement dated 16.08.2024 of her own free will and without any pressure, coercion, undue influence or threat. She has further stated that pursuant to the settlement, she and petitioner No. 1 have resumed cohabitation and are residing together at their matrimonial home. She has no objection if the aforementioned FIR and all proceedings arising therefrom are quashed. 7. In view of the above, since the parties have amicably resolved their matrimonial disputes of their own free will and without any pressure, coercion, undue influence or threat, and have resumed cohabitation, no useful This is a digitally signed order. purpose would be served by continuing the proceedings. Rather, continuation thereof may only give rise to further acrimony and unnecessary litigation between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end. Accordingly, the aforesaid FIR and all proceedings arising therefrom are liable to be quashed. 8. Accordingly, FIR No. 0293/2022, registered at Police Station Mansarovar Park, District Shahdara, Delhi for offences punishable under Sections 498A and 406 read with Section 34 of the IPC read with Section 4 of the Dowry Prohibition Act, 1961 and all consequential proceedings emanating therefrom, are hereby quashed. 9. Therefore, the present petition is allowed and stands disposed of. 10. Pending application(s), if any, also stand(s) disposed of. 11.
