JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.2 in SC No.120/2025, pending before the Court of Principal District and Sessions Judge, Davanagere, arising out of the Crime No.64/2025 registered by Vidyanagar Police Station, Davanagere, for offences punishable under Sections 309(6) 311, 61(2) and 238 of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the petitioner and the learned High Court Government Pleader on behalf of respondent-State. 3. FIR in the present case was registered by Vidyanagar police station, Davanagere in Crime No.64/2025 initially for offences punishable under Sections - 3 - HC-KAR NC: 2026:KHC:25382 CRL.P No. 17521 of 2025 309(6) and 311 of BNS 2023, against unknown persons. During the course of investigation, petitioner herein was arrested on 27.03.2025 and remanded to judicial custody. After completing investigation, charge sheet has been filed against three persons for the aforesaid offences and the petitioner is arrayed as accused No.2 in the charge sheet. His bail application filed before the Trial Court in Crl.Misc.No.707/2025 was rejected on 24.07.2025. It is under these circumstances, he is before this Court. 4. Perusal of the material on record would go to show that the allegation against accused Nos.1 to 3 in the charge sheet is that they had conspired to commit robbery in the house of the first informant and as per the conspiracy, accused No.1 had entered the house of first informant on 21.3.2025 and after assaulting Rangamma, who is the mother of the first informant, he had taken away the gold and silver jewelry and also cash from the house which totally valued at Rs.9,45,000/-. - 4 - HC-KAR NC: 2026:KHC:25382 CRL.P No. 17521 of 2025 5. During the course of investigation, all the accused persons have been arrested in the present case. The allegation of entering the house, committing robbery and assaulting the inmates of the house is only as against accused No.1. Accused No.2 is the father of accused No. 3. Allegations as against accused Nos.2 and 3 are similar in the charge sheet. Accused No.3 has been granted regular bail in the present case by the Co-ordinate Bench of this Court in Crl.P No.11616/2025. Under the circumstances, the petitioner, who is in custody, is also entitled to be enlarged on bail on the ground of parity. Accordingly, the following: ORDER The petition is allowed. The petitioner/accused No.2 is directed to be enlarged on bail in Crime No.64/2025 registered by Vidyanagar Police Station, Davanagere, for offences punishable under Section 309(6) 311, 61(2) and 238 of BNS, 2023 subject to following conditions: - 5 - HC-KAR NC: 2026:KHC:25382 CRL.P No. 17521 of 2025 i) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like-sum to the satisfaction of the Trial Court. ii) Petitioner shall not tamper the prosecution witnesses either directly or indirectly. iii) Petitioner shall attend the Trial Court on all dates of hearing unless exempted and shall co- operate for the speedy disposal of the case. iv) Petitioner shall not commit any offence.
