The petitioner is apprehending his arrest in connection with Pakur (Town) P.S. Case No. 232 of 2025, registered for the offence under Sections 69, 126(2), 115(2), 303(2), 76 and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Pakur. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and the allegations are made of establishing the relationship on the pretext of marriage. He next submits that the informant is a married lady and having three children and what has happened that is consensual in nature. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioner. 4. Learned A.P.P. appearing for the State and learned counsel appearing for the informant have jointly opposed the prayer and submits that the allegations are there of establishing the relationship on [ 2026:JHHC:18993] -2- the false pretest of marriage. On these grounds, they submit that anticipatory bail may kindly be rejected. 5. In the FIR, it has come that the petitioner and the informant have came into contact and thereafter relationship was established. In the FIR, it has been further stated that both have resided in Deoghar, Sahibganj and even in the parental house of this petitioner and further the married lady has established the relationship. Prima Faci it appears what has happened that was consensual. 6. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 7. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Pakur, in connection with Pakur (Town) P.S. Case No. 232 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated:-30.06.2026 Amitesh/-
