The petitioner is seeking some exemption and relief on road tax on the ground that his vehicle met with an accident and he was not in a position to pay the same and pay the tax since the vehicle was not in running condition during the period. He submits that as the vehicle was under repair, he could not pay the tax but due to non-payment of the same, the authorities imposed the penalty of Rs.96,000/-, which he cannot pay now. 3. Ultimate prayer of the petitioner is to allow exemption for payment of road tax, which this Court by exercising jurisdiction under Article 226 of the Constitution of India cannot allow. The petitioner, if so at all advised may approach the District Transport Officer or the Secretary, Transport Department, who will consider the case of the petitioner strictly as per law and take an appropriate decision and communicate the same to the petitioner. 4.
