The Court made the following Order:
The petitioners herein, had filed O.S.No.390 of 2016, before the learned Civil Judge (Senior Division), Sattenapalli, for grant of permanent injunction against the respondents herein. This suit has been pending for the last ten years. 2.
The petitioner has approached this Court for a direction to the trial Court to dispose of the suit, inasmuch as the delay in the disposal of the suit is causing extreme hardship to the petitioner and also on the grant that further passage of time would also result in a situation where the witnesses necessary for proving the case of the petitioner may become unavailable. 3. In view of the fact that the suit has been pending for the last ten years without the trial being taken up, it must be held that there has been a violation of the rights of the petitioner for a speedy trial. 4. In these circumstances, this Civil Revision Petition is allowed with a direction to the trial Court to dispose of O.S.No.390 of 2016 as expeditiously as possible, and at any rate within a period of six (06) months from the date of receipt of copy of this order. 5. This order is passed without notice being given to the respondents, inasmuch as the said order does not in any manner affect the rights of the said respondents.
