The petitioners are apprehending their arrest in connection with Hanwara P.S. Case No. 05 of 2026, registered for the offence under Sections 80 and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Godda. 3. Learned counsel appearing for the petitioners submits that the petitioners are father-in-law, mother-in-law and sisters-in-law of the deceased. He further submits that the charge sheet was already submitted against the husband and he has faced the trial and has been acquitted by the learned Sessions Judge in Sessions Trial No.210 of 2026. He next submits that in the post-mortem report, it has come that death has occurred due to Asphyxia on account of ante mortem hanging. On these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposes the prayer and submits that the petitioners are in-laws of the deceased. 5. Considering that the petitioners are father-in-law, mother-in-law and sisters-in-law of the deceased and the investigation against these petitioners is kept pending however, the charge sheet has been submitted against the husband, who has faced the trial and he has been acquitted by 2026:JHHC:18825 the learned Sessions Judge in Sessions Trial No.210 of 2026 and the death is said to be due to Asphyxia on account of ante mortem hanging, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioners. 6. Accordingly, the above-named petitioners are directed to surrender before the learned court within two weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Godda, in connection with Hanwara P.S.
