Heard the parties. The petitioner has been made accused in connection with Harla P.S. Case no 185 of 2025 corresponding to G.R. case no. 381 of 2026 ( S.T. case no. 135 of 2026) instituted under Section 140(3), 3(5) of BNS,

Learned senior counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of the common intention with the co-accused persons abducted the husband of the informant and committed his murder. It is submitted that the allegation against the petitioner is false. It is further submitted by learned counsel for the petitioner that the petitioner has surrendered before the court on 16.12.2025 and has been taken to police remand on 22.12.2025 for interrogation but all the recoveries were made prior to 16.12.2025 and at best, the allegation against the petitioner is that the petitioner has caused the dis-appearance of the evidence of the murder; which is a bailable offence. It is next submitted that there is no allegation against the petitioner of committing murder of the deceased and he has been implicated in this case merely on the basis of
suspicion. It is next submitted that the petitioner has been in jail custody since 16.12.2025, as mentioned in para 12 of this bail application. It is next submitted by learned counsel for the petitioner that the petitioner is ready and willing to co-operate with the trial of the case and undertakes not to annoy or disturb the informant or the other witness of the case in any manner during trial of the case nor to enter in the district of Bokaro except for the purpose of attending the court in connection with this case on the date to be fixed by the court concerned, hence, the petitioner may be admitted to bail. Learned Addl.
Learned Addl. P.P. opposed the prayer for bail. Considering submissions of learned counsels and the facts as stated above, I am inclined to release the petitioner on bail.
