1. This hearing has been conducted through hybrid mode. 2. The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as ‘BNSS’], seeking quashing of FIR No. 82/2021 dated 06.04.2021, registered at Police Station Shahdara, District Shahdara, Delhi, in respect of offences punishable under Sections 323, 354, 354B, 451, 506 read with Section 34 of the Indian Penal Code, 1860 [hereinafter referred to as ‘IPC’], and all proceedings emanating therefrom, on the basis of the mediation settlement agreement arrived at between the parties. 3. Issue notice. The learned APP for the State accepts notice on behalf of the State. 4. The petitioner and respondents no. 2 are present before this Court and This is a digitally signed order. have been duly identified by their respective learned counsels and Investigating Officer [IO]. 5. Briefly stated, the present FIR arose out of a dispute between the parties, who are related to each other. During the pendency of the proceedings, the parties amicably resolved their disputes through mediation vide Settlement Agreement dated 05.04.2025. In terms thereof, respondent No. 2 agreed not to pursue the proceedings against the petitioners and to cooperate with them in seeking quashing of the aforesaid FIR. 6. On a query made by this Court, respondent No. 2, who has been duly identified by the IO, states that she entered into the Mediation Settlement Agreement dated 05.04.2025 of her own free will and without any pressure, coercion, undue influence or threat. She further states that she has no objection if the aforementioned FIR is quashed. 7.
In view of the above, since the parties have amicably resolved their differences of their own free will and without any pressure, coercion, undue influence or threat, no useful purpose would be served by continuing the proceedings. Rather, continuation of the proceedings may only give rise to further acrimony between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end. 8. Accordingly, FIR No. 82/2021, registered at Police Station Shahdara, District Shahdara, Delhi for the offences punishable under Sections 323, 354, 354(B), 451, 506 read with Section 34 of the IPC along with all consequential proceedings emanating therefrom, is hereby quashed. 9. Therefore, the present petition is allowed and thereby, disposed of. 10. The pending application also stands disposed of. This is a digitally signed order.
