Joshi, Advocate For the State :- Mrs. Lily Sahay, Advocate ---- 04/10.02.2026 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State. 2. The petitioners are apprehending their arrest in connection with Narayanpur P.S. Case No.71 of 2025, for the alleged offences registered under Sections 318(2) (4), 338, 336(3), 340(2) and 61(2) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned A.C.J.M., Jamtara. 3. Learned counsel appearing for the petitioners submits that there was an agreement between Mithalesh Srivastava and informant for supply of certain electronic appliances for which Rs.5,71,500/- was paid by the informant to Mithalesh Srivastava. He further submits that Mithalesh Srivastava has already supplied the 2026:JHHC:3455 --2-- A.B.A. No. 716 of 2026 goods worth Rs.1,75,000/- at the shop of the informant and further goods worth Rs.63,650/- were delivered by Mithalesh Srivastava on 20.04.2025 and invoices of those has been considered by this Court in ABA No.6429 of 2025. He then submits that the allegations are there of not delivering of the rest of the goods by Mithalesh Srivastava. He next submits that so far these petitioners are concerned they are the employee of Mithalesh Srivastava and on instruction of Mithalesh Srivastava certain amount has been transferred in the petitioners’ account and that has been subsequently taken by Mithalesh Srivastava. He also submits that Mithalesh Srivastava has already been granted anticipatory bail in ABA No.6429 of 2025. He next submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.16 of the petition. 4. Learned counsel appearing for the State opposes the prayer and submits that money on instruction of one Mithalesh Srivastava has also been transferred in the account of the petitioners. 5. Considering that the petitioners are said to be employee of Mithalesh Srivastava and Mithalesh Srivastava has already been granted anticipatory bail by this Court in the aforesaid ABA and it has been pointed out that money transferred on instruction of Mithalesh Srivastava in the account of these petitioners and the money has already been taken by Mithalesh Srivastava and the petitioners have got no criminal antecedent as disclosed in 2026:JHHC:3455 --3-- A.B.A. No. 716 of 2026 paragraph No.16 of the petition, I am inclined to provide anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Jamtara in connection with Narayanpur P.S.
