1. Petitioner has filed this writ petition seeking following reliefs:- ‘10.1 That, the Hon’ble Court may be pleased to issue writ of mandamus commanding the respondents as to give the benefit of the amount of time pay scale and up-gradation from the year 2013 to 30.06.2023. 10.2 That, the Hon’ble Court may be pleased to issue Writ of mandamus commanding the respondents as to calculate the pension of the petitioner by including the amount of time bound pay scale and amount of up- gradation. 10.3 Any other relief may kindly be given to the petitioner as this Hon’ble Court may think fit and proper.”

Learned Counsel for the petitioner submits that petitioner joined the service on the post of Child Development Project Officer on 30.03.1996 and after attaining the age of superannuation got retired on
30.06.2023. He submits that during the period of service petitioner was not extended the benefit of time pay scale. According to circular issued by State Govt. the Govt. servant are entitled for time scale pay after completion of respective period of service and, therefore, the retiral dues computed is less. He also submits that petitioner has submitted representation Annexuer P-1 in this regard, however, it has not been considered and decided till date. He further submits that direction be
3 / 3 issued to concerned authority to consider and take decision on representation submitted by petitioner.

Learned counsel for State submits that he is having no objection to the limited prayer made by learned counsel for petitioner, however he submits that the representation which is placed on record as Annexuer P-1 is not submitted before the competent authority.

At this stage, learned counsel for petitioner would submit that he may be permitted to submit fresh comprehensive representation before respondent no. 3 (competent authority) and in turn direction be issued to concerned authority to consider and take decision on representation to be submitted by petitioner at the earliest.

On due consideration of submission made by learned counsel for the respective parties, this writ petition at this stage is disposed of permitting petitioner to submit fresh comprehensive representation before respondent no. 3 and if such a representation is submitted by petitioner, concerned authority shall consider and take decision on representation to be submitted by petitioner, in accordance with law, expeditiously, preferably within a further period of 03 months from the date of receipt of representation.
6. With the aforesaid observation and direction, this writ petition stands
