01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Kabisuryanagar P.S. Case No.232 of 2026 corresponding to G.R. Case No.228 of 2026 pending in the file of learned J.M.F.C., Kabisuryanagar on the grounds stated therein. 3. Perused the FIRs as at Annexures-1 & 2. It is submitted by the learned counsel of the petitioners that there is counter FIR i.e. Annexure-2 dated 19th April, 2026 followed by the report of the informant on 21st April, 2026 with false allegations made therein. It is submitted that both sides have received injuries for having exchanged assault during the alleged incident. As far as instructions received, it is claimed that no one from the side of the informant received serious
injury. It is also claimed that the petitioners received injury as well for the alleged incident. 4. Recorded the objection of the State. From the FIR, this Court finds that the petitioners committed the overt acts and assaulted the informant’s husband and other family members. The details of the incident stand narrated therein. Considering the above facts and the submissions of learned counsel for the respective parties, this Court is inclined to direct the petitioners, for having no other antecedents as pleaded, to surrender before the learned court below for being released though is not inclined to entertain their bail plea. 5. Accordingly, it is ordered. 6. In the result, the ABLAPL is disposed of. It is directed that in the event, the petitioners surrender before the learned J.M.F.C., Kabisuryanagar in connection with Kabisuryanagar P.S. Case No.232 of 2026 corresponding to G.R. Case No.228 of 2026 within a fortnight from today, they shall be released on bail on furnishing a bail bond of Rs.30,000/-(thirty thousand only) each for the like amount each and on such other terms and conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, they shall not commit any further mischief involving the informant. It is further directed that the above order shall not be given effect to if the petitioners do have antecedents and anyone from the side of the informant received grievous injury during the alleged incident.
However, it is made clear that the release of
the petitioners shall be acted upon if the petitioners or anyone from their side equally received grievous injury. 7. Issue urgent certified copy as per rules. (R.K. Pattanaik) Judge Alok
