2. The petitioner is apprehending his arrest in connection with Katkamsandi P.S. Case No.29 of 2026, for the alleged offences registered under Sections 126(2), 115(2), 118(2), 109(1), 74, 85, 351(2), 352 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned J.M. 1st Class, Hazaribagh.

Learned counsel appearing for the petitioner submits that there are case and counter case and the altercation took place due to some family dispute. He further submits that the petitioner happened to be brother-in-law of the informant. He then submits that the injury is found to be simple and the learned Sessions Judge has also held that Section 109(1) of Bharatiya Nyaya Sanhita, 2023 is not attracted. On these grounds, he submits that anticipatory bail

may kindly be granted.

Learned counsel appearing for the State opposed the prayer and submits that the petitioner happened to be brother-in-law of the informant and the allegations are there of outraging the modesty and in view of that the anticipatory bail may kindly be rejected.
5. Considering that there are case and counter case and the entire family members have been made accused and the injury is said to be simple, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned J.M. 1st Class, Hazaribagh in connection with Katkamsandi P.S. Case No.29 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
