JUSTICE SANJEEV NARULA O R D E R % 16.09.2026 1. The Petitioner asserts rights over land comprising Khasra Nos. 16/7/1, 16/14 and 16/7/2, situated in the revenue estate of Village Tatesar, Delhi. Although the petition traces the history of demarcation proceedings concerning the subject land from 2003 onwards, it is unnecessary to advert to the same, as the present grievance arises from subsequent events. On 15th May, 2026, a nishandehi/demarcation exercise was carried out in respect of the subject land. The proceedings drawn on the said date, placed on record as Annexure P-1, record that the demarcation points were fixed at the site in the presence of the Tehsildar and other concerned persons. 2. He accordingly submitted complaints to the SDM, Mundka as well as the Deputy Commissioner of Police, District Rohini. The complaint made to the SDM was forwarded to the SHO, P.S. Kanjhawala for appropriate action. On the complaint made to the police, Non-Cognizable Offence Information Report No. 0025/2026 dated 5th August, 2026 has also been registered at P.S. Kanjhawala. The grievance of the Petitioner is that any alteration of the points fixed during nishandehi may affect the demarcation and prejudice his rights. 3. Mr. Lalltaksh Joshi, counsel for GNCTD, on instructions, submits that the dispute is essentially between the Petitioner and certain private parties and that the State has no role in such private dispute. He states that, in the absence of specific instructions, he is unable to confirm whether the demarcation points fixed on 15th May, 2026 have in fact been altered. 4. In view of the above, the present petition is disposed of with a direction to the concerned SDM and Tehsildar to verify whether the demarcation points fixed pursuant to the nishandehi/demarcation exercise dated 15th May, 2026 remain at their original locations. The same may be verified from the records maintained by the revenue authorities and/or the TSM Surveyor. In case any alteration is found, the demarcation points shall be re-fixed by the TSM Surveyor, in accordance with law and in the presence of all concerned parties. Any additional cost incurred for this purpose shall be borne by the Petitioner. 5. Insofar as the complaint made to the police is concerned, the police authorities shall proceed thereon in accordance with law. 6.
