1. This writ petition has been filed by the petitioner under Article 226 of the Constitution of India seeking expunction of adverse remarks recorded against her in the order dated 01.09.2025 passed by the learned Judicial VED PRAKASH DEWANGAN Digitally signed by VED PRAKASH DEWANGAN Date: 2026.03.24 20:32:29 +0530
2 Magistrate First Class, Raipur in Criminal Case No. 17873/2023 (State of Chhattisgarh vs. Anjali Vaishnav @ Riya), arising out of Crime No. 161/2023 registered at Police Station Amanaka, Raipur, as well as for quashing of the consequential show cause notice dated 04.02.2026 issued by the Commissioner of Police, Raipur pursuant to the directions contained in the said order.
2. The petitioner has filed the present petition seeking for the following reliefs:
“10.1 That, this Hon’ble Court may kindly be pleased to expunge the adverse/objectionable remarks made against the petitioner in the order dated 01.09.2025 (Annexure-P/1) passed by the learned Judicial Magistrate First Class, Raipur, District Raipur (CG) in Criminal Case No. 17873/2023 (State of Chhattisgarh Vs. Alleged accused) arising out of Crime No. 161/2023 registered at Police Station Amanaka, Raipur. 10.2 That, this Hon’ble Court may kindly be pleased to issue appropriate writ(s)/ direction(s)/
order(s) for quashment of explanation/show-cause notice dated 04.02.2026 (Annexure-P/2) issued to the petitioner by the Police Commissioner, Raipur. 10.3 That, this Hon’ble Court may kindly be pleased to issue appropriate writ(s)/ direction(s)/
order(s) quashing all the subsequent consequential proceedings initiated against the petitioner. 10.4 That, this Hon’ble Court may kindly be pleased to pass appropriate orders, in favor of the petitioner, so far as the cost of the litigation and other miscellaneous expenses are concerned. 10.5 That, this Hon'ble Court may kindly be pleased to grant any such other relief in favor of petitioner as this Hon'ble Court may deem fit in the interest of Justice.”

3. After arguing the matter for some time, learned counsel for the petitioner seeks permission of this Court to dismiss the present petition as withdrawn in view of the fact that the matter is presently under
consideration before the Commissioner of Police, Raipur. It is further submitted that if the petitioner is aggrieved by any action taken against her, she shall be at liberty to take recourse to appropriate remedy in accordance with law.
4. Learned State counsel has no objection if the present petition is dismissed as withdrawn with liberty to the petitioner to avail appropriate remedy, in accordance with law, in the event she is aggrieved by any
order that may be passed by the competent authority.
5. Considering the submission made by learned counsel for the petitioner and taking into account the fact that the matter is presently under
consideration before the competent authority, this Court is inclined to permit withdrawal of the present petition.
