The petitioner is apprehending his arrest in connection with Herhanj P.S. Case No.08 of 2026 for the alleged offences registered under Sections 17, 18 and 29 of NDPS Act pending in the Court of learned Special Judge, NDPS, Latehar. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and false allegation is made of cultivation of poppy plants on the forest land. He further submits that the petitioner has nothing to do with the said allegation and even the land is not belonging to the petitioner. He then submits that in identical situation co-accused persons have already been granted anticipatory bail in ABA Nos.2468 of 2026, 2469 of 2026, 2598 of 2026 and 2838 of 2026. On these grounds, 2026:JHHC:18974 --2-- A.B.A. No. 3469 of 2026 he submits that anticipatory bail may kindly be allowed. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of cultivation of poppy plants on the forest land. 5. Considering that the land is of the forest department and that is not belonging to the petitioner and in identical situation co- accused persons have already been granted anticipatory bail in the aforesaid ABAs, I am inclined to provide anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Special Judge, NDPS, Latehar in connection with Herhanj P.S. Case No.08 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated 30.06.2026 Sangam/
