The present writ petition has been filed seeking following reliefs: “a) allow present writ petition and issue a Writ of Mandamus or any other appropriate writ, order or direction, thereby, restraining Respondent No.1 Corporation from taking any coercive action, including but not limited to sealing and demolition action in pursuance of demolition order dated 28.08.2026 passed by Respondent No.1 against the property of the Petitioners bearing No. 108, Pocket- 6, Sector-24, This is a digitally signed order. The petitioner has impugned the demolition order dated 28th August, 2026, stated to have been served on the petitioner on 10th September, 2026. A show cause notice was issued to the petitioner on 29th July, 2026, alleging the unauthorised construction in the subject property. The petitioner responded to the said show cause notice on 21st August, 2026 and sought further time to file a response. 4. Despite the petitioner having specifically sought time to file a response and produce the relevant documents, the respondent/MCD did not pass any order/direction on the said communication and proceeded to pass the impugned demolition order dated 28th August, 2026. 5. I have heard the counsel for the parties. 6. Taking note of the aforesaid facts and circumstances, the impugned demolition order dated 28th August 2026 is set aside. The petitioner is granted two (2) weeks’ time to file a reply to the show cause notice dated 29th July, 2026 issued by the respondent/MCD. Thereupon, the respondent/MCD shall grant a fresh personal hearing to the petitioner and adjudicate the show cause notice. 7. The writ petition stands disposed of in the aforesaid terms. 8. In the event the petitioner has any further grievance, he is at liberty to take appropriate remedies in accordance with law. This is a digitally signed order.
