JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.5 is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail in Crime No.9/2025 registered by Kuderu Police Station, Chamarajanagar District, for offences punishable under Sections 4 and 5 of the Explosive Substances Act, 1908, under Section 9B(1)(b) of the Explosive Act, 1884 and Section 325 of BNS, 2023.
2. Heard the learned counsel for the petitioner and learned High Court Government Pleader on behalf of the respondent-State.
3. F.I.R. in Crime No.9/2025 was registered by Kuderu Police Station, Chamarajanagar District, for the aforesaid offences against unknown persons based on the first information dated 28.01.2025 received from

HC-KAR NC: 2026:KHC:25680 CRL.P No. 1421 of 2026 Gurusiddaiah. Apprehending arrest in the case, petitioner had filed Crl.Misc.No.519/2025 before the jurisdictional Sessions Court, which has been rejected on 16.12.2025. It is under these circumstances, petitioner is before this Court.
4. In the complaint lodged on 28.01.2025 by Gurusiddaih, he has stated that his cow, which was left out for the purpose of grazing had suffered injury to its mouth and other parts of the body. The injuries were allegedly caused by an explosion that occurred while the cow was eating the fodder, in which explosive substance was kept by unknown person. It is under these circumstances, FIR in Crime No.9/2025 was registered by Kuderu Police Station, Chamarajanagar. Accused Nos.1 and 2 in the said case have been granted anticipatory bail by co-ordinate Bench of this Court in Crl.P.No.12669/2025 c/w Crl.P No.12643/2025 on the ground that they have been arrayed as accused only on suspicion and there was no material to connect them to the crime. Even as against the

HC-KAR NC: 2026:KHC:25680 CRL.P No. 1421 of 2026 petitioner, there is no other material to connect him to the crime and only on suspicion he has been arrayed as accused. Undisputedly, he is not a person with any criminal antecedent and he is an agriculturist by avocation.
5. Under these circumstances, I am of the opinion that without expressing any opinion on the merit of the case, the prayer made by the petitioner for grant of anticipatory bail is to be allowed. Accordingly, I pass the following:
ORDER (i) The criminal petition is allowed. (ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.9/2025 registered by Kuderu police station for the offences punishable under Sections 4 and 5 of the Explosive Substances Act, 1908, under Section 9B(1)(b) of the

HC-KAR NC: 2026:KHC:25680 CRL.P No. 1421 of 2026 Explosive Act, 1884 and Section 325 of BNS, 2023, subject to the following conditions: (a) The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. (b) Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. (c) Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. (d) The petitioner shall not involve in similar offences in future.
