Agarwal, Spl.PP. ---- 2/30.06.2026 Heard learned counsels for petitioner and for State. 2. The petitioner is apprehending his arrest in connection with Pithoria PS Case No.30 of 2026, for offence registered under section 7 of Essential Commodities Act, 1955, pending in court of learned Sub Divisional Judicial Magistrate, Ranchi. 3. Learned counsel for petitioner submits that the petitioner is the owner cum driver of Tempo and the allegations are made of carrying 14 domestic LPG gas cylinder on the said Tempo. He also submits that the said cylinders were being taken by the petitioners on the instruction of Sunil Kumar @ Sunil Kumar Sao who has been granted anticipatory bail in ABA No.3034 of 2026. He also submits that the petitioner will not claim the said gas cylinders. He next submits that the petitioner has got no criminal antecedent as disclosed in paragraph no.17 of the petition. 4. Learned State counsel opposes prayer and submits that on 2026:JHHC:19041 2 the Tempo of the petitioner itself the said domestic LPG gas cylinders were found to be carried and, on these grounds, he submits that anticipatory bail may kindly be rejected. 5. Considering that the petitioner is owner cum driver of the Tempo in question and the allegations are made of carrying 14 domestic LPG gas cylinders and the petitioner has got no criminal antecedent and it has been pointed out that on the instruction of Sunil Kumar @ Sunil Kumar Sao the said domestic LPG gas cylinders were loaded on the said Tempo of the petitioner and he has been granted anticipatory bail as aforesaid, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Sub Divisional Judicial Magistrate, Ranchi, in connection with Pithoria PS Case No.30 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
