The prayer for bail of the petitioner was earlier dismissed as withdrawn in B.A. No. 4516 of 2025 and was dismissed on merits in B.A. No. 645 of 2026. Submission has been advanced by the learned counsel for the petitioner that the informant is the sole eye witness to the occurrence and he has been examined as P.W.9 and declared hostile by the prosecution. Learned counsel submits that the petitioner is in custody since 17.12.2024. Learned Spl. P.P. has opposed the prayer for bail of the petitioner. Regard being had the informant having been declared hostile by the prosecution, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Nagar Untari, Garhwa in connection with Nagar Untari P.S. Case No. 239/2024, subject to the condition that the petitioner shall remain present before the learned trial court on each and every date till the conclusion of trial unless prevented by sufficient cause.
